“Viewed in hindsight—always a distorting perspective—it appears that Oetting as one of seven class representatives has himself gone to great lengths to make this a ‘lawyer-driven lawsuit.’ We hope district courts in this circuit will bear this in mind should Oetting seek to be appointed a lead plaintiff in future class actions subject to the PSLRA,” the appeals court wrote.
